1. Acceptance of Terms

By accessing, browsing, or purchasing from this website (hereinafter referred to as "DiecastSquad"), you explicitly agree to be bound by the terms, conditions, and notices contained herein. If you do not agree to these terms, you must cease using this Store immediately. DiecastSquad reserves the right to modify these terms at any time without prior notice.

2. Collectible Item Condition & "As-Is" Policy

DiecastSquad specializes in vintage, rare, and collectible die-cast vehicles and memorabilia.

  • Packaging and Condition: Due to the age and collectible nature of these items, packaging conditions (including but not limited to card back creases, soft corners, vein lines, blister pack scuffs, or minor factory print defects) will vary.

  • All items are sold strictly "As-Is" regarding packaging and card condition. Minor factory variances or minor cosmetic packaging wear do not constitute a defective product.

  • Factory Sealed Integrity: To protect the market integrity of collectible items, any product sold as "Factory Sealed" by DiecastSquad is considered a final sale. Once shipped, returns on factory-sealed items are strictly prohibited, regardless of whether the seal remains intact.

3. Product Safety, Age Restrictions, & Liability Waiver

  • Not Toys for Small Children: Products sold on DiecastSquad are intended strictly for adult hobbyists and collectors. They are not designed, marketed, or intended as toys for children.

  • Choking & Sharp Object Hazard: Die-cast models may contain small parts, rubber tires, sharp edges, or materials that pose a severe choking hazard or risk of injury. These items are strictly unsafe for children under the age of 14.

  • Assumption of Risk: By purchasing from DiecastSquad, the buyer assumes all responsibility and liability for the safe storage and display of these items. DiecastSquad, its owners, parents, and affiliates assume absolutely zero liability for injury, harm, choking, or misuse resulting from these collectible items entering the hands of minors.

4. Shipping, Carrier, and Lost/Stolen Package Disclaimer

  • Transfer of Risk: All shipments are sent via third-party carriers (e.g., USPS, UPS, FedEx). The risk of loss and title for all merchandise passes to the buyer the moment the package is transferred and scanned in by the shipping carrier.

  • Lost, Stolen, or Delayed Goods: DiecastSquad is not responsible for transit delays, packages lost by the carrier, or items stolen from a delivery site after carrier confirmation of delivery (e.g., porch piracy).

  • Claims: Any claims for missing, damaged-in-transit, or misdelivered shipments must be filed directly by the customer with the respective shipping carrier. DiecastSquad will provide necessary tracking information to assist but will not issue refunds or replacements for carrier-inflicted issues.

  • Return to Sender: Any package returned to DiecastSquad due to buyer refusal, failure to pay international customs/duties, or an incorrect address provided at checkout will be subjected to a 12% restocking fee, and the cost of return transit will be deducted from any final eligible refund.

5. Comprehensive Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall DiecastSquad, its founders, owners, employees, or suppliers be liable for any direct, indirect, incidental, punitive, special, or consequential damages whatsoever (including, without limitation, damages for loss of profits, business interruption, personal injury, or property damage) arising out of or in connection with the use of this website or the products purchased through it.

The total aggregate liability of DiecastSquad to you for any and all claims arising out of a purchase is strictly limited to the exact purchase price paid by you for the specific item causing the dispute.

6. Governing Law

These terms, your use of this website, and any purchase disputes shall be governed by and construed in accordance with the laws of the State of Connecticut, United States, without regard to its conflict of law provisions. Any legal action arising from the use of DiecastSquad must be filed in the appropriate state or federal courts located in Connecticut.
